General conditions of Portal use
1. Acceptance
These General Conditions (hereafter referred to as : "General Conditions") regulate
the use of the Internet portal service www.azuldecortes.com (hereafter referred
to as: "Portal") that JUANDRO, S.L. (hereafter referred to as: "Holder") provides
free of charge to Internet Users.
Access to and/or use of the Portal confers to any person and/or entity the status
of Portal user (hereafter referred to as: User) and implies the User's full and
unreserved acceptance of each and every General Condition in the version published
by the Holder at the time the User accesses the Portal. You are therefore strongly
advised to read the General Conditions each time you visit the Portal, given that
simply using the Portal involves your complete and unconditional acceptance of the
General Conditions.
Access to and/or use of certain Services and Materials offered to Users in and/or
via the Portal is subject to specific Particular Conditions which, depending on
the circumstances, replace, complete and/or modify the General Conditions (hereafter
referred to as: "Particular Conditions"). Before access to and/or use of the said
Services and Materials, the User is also strongly advised to carefully read the
relevant Particular Conditions. Access to and/or use of the said Services and Materials
implies complete and unconditional acceptance of the Particular Conditions in the
version published by the Holder at the time of the said access to and/or use of
the Portal.
2. Objective
Via the Portal, the Holder facilitates the Users' access to and use of various Services
(hereafter referred to as: "Services") and Materials provided for the Users by the
Holder or third parties (hereafter referred to as: "Materials").
The Holder reserves the right to modify at any time and without prior announcement
the presentation and configuration of the Portal, by changing, removing or adding
to the Materials and Services offered through the Portal, the manner in which these
are presented or localised, as well as the conditions laid down for access to and/or
use of the Portal and its Services.
Provision of the Portal service and the other Services is of an indefinite duration.
The Holder, however, is entitled to unilaterally terminate, suspend or interrupt,
at any time and without prior notice, provision of the Portal service and/or any
of the Services, without prejudice to what may have been stipulated in this regard
in the corresponding Particular Conditions.
3. Access to and use of the Portal
1.- The User undertakes to use the Portal, Services and Materials in accordance
with the law, moral standards, public policy, good conduct, and in accordance with
the terms stipulated in these General Conditions. In turn, the User will refrain
from using the Portal and its Services for purposes or aims which are unlawful,
harm the rights and interests of third-parties, are contrary to these General Conditions
or may in any way damage, disable, overload or impair the Portal and its Services
and/or Materials or interfere with its normal use and enjoyment.
2.- The User will refrain from obtaining or trying to obtain information, messages,
graphics, drawings, sound and/or image files, photographs, recordings, software
and, in general, any type of material accessible from the Portal or from the Services
(hereafter referred to as: "Materials") employing for this purpose means or procedures
different to those, that according to the circumstances, have been put at the User's
disposal or have been indicated for this purpose on the Web pages in which the Materials
are located.
3.- The User undertakes to use the Materials in a diligent, correct and lawful manner
and, in particular, undertakes to refrain from: a) taking part in conduct that is
unlawful, illegal or contrary to good conduct or public policy; b) disseminating
Materials or propaganda which may be racist, xenophobic, pornographic, promoting
terrorism or contravening human rights; c) causing damage to systems belonging to
the Holder, suppliers or third-parties, introducing or disseminating computer viruses
over the net or using any other systems that may cause damage; d) attempting to
access and/or use other Users' email accounts and modifying or manipulating their
messages.
4.- The User undertakes to make diligent use of and keep secret password/s and username/s
assigned to him to gain access to the Portal and/or the Services. The User will
accept liability for losses and damages and detriments incurred as a result of the
Services being used by any third-party who has used for this purpose the User's
password or user name due to lack of diligent care or loss of these by the User.
5.- The User undertakes to observe diligently and faithfully any instruction issued
by the Holder or by personnel authorised by the Holder relating to the use of the
Portal and its Services.
6.- The User will be responsible for any type of damage and detriment that may be
incurred by the Holder due to failure to comply with any of the obligations to which
he is subject.
7.- The User will choose and indicate his own Passwords. These may not be dictionary
words, expressions or insults of any type, defamatory, coinciding with brand names,
trade-marks, business signs, official company names, logos, names and pseudonyms
of public figures and/or entities whose use is not authorised, and which may in
any case be considered as contrary to the law, moral standards and/or good conduct.
The User accepts responsibility for the Passwords, will not disclose them to any
third parties and will notify the Holder immediately of their loss, theft and/or
risk of disclosure to a third party.
8.- Any hyperlink in another webpage or in the Portal (hereafter referred to as:
Hyperlink) is subject to the following conditions: a) it must only allow access
to the Portal pages, but it will never reproduce them in any way, b) it may only
be inserted in the Portal's home page or at the beginning of each of its sections;
c) it is not permitted to create a browser or a border environment on the Portal
pages; d) the web page that contains the hyperlink must not contain unlawful information
or content that is contrary to moral standards and/or good conduct.
The establishment of a hyperlink does not in any case imply the existence of any
relationship between the Holder and the owner of the webpage in which the link is
established, nor does it imply the Holder's acceptance and approval of its contents
or services.
4. Exclusion of guarantees and responsibility
1.- The Holder does not guarantee the availability or continuity of the correct
functioning of the Portal and its Services, and in particular rules out any responsibility
for damages and detriments of any sort that could be caused by the lack of availability
or continuity of the correct functioning of the Services.
2.- The Holder does not guarantee that the Portal and its Services will be useful
for the execution of any activity in particular.
3.- Under no circumstances will the Holder be held responsible for possible failures
and/or damages and/or detriments caused by the products and/or Materials and/or
Services that might be bought, reserved and/or hired by the Users from the Portal.
The Holder remains separate from any possible contractual or non-contractual connection
that may link the suppliers of the Materials and/or Services with the Users.
4.- Although the Holder acts in good faith, he cannot supply prior checks on, nor
guarantee the absence of viruses or other damaging elements in, Services that are
provided in the Portal, or in the Materials.
5.- The Holder does not guarantee the legality, reliability and usefulness of the
Services and/or Materials, rejects all responsibility for damages or detriments
of any kind that may be caused by Services provided by third parties on the Portal,
including storage, transmission, diffusion, reception, obtaining, availability,
or access to the Materials. In particular, although not exclusively, the Holder
denies all responsibility for damages and detriments that may be due to: a) failure
to comply with the law, moral standards, good conduct or public order; b) the infringement
of intellectual and industrial property rights, corporate secrets, contractual agreements
of any kind, defamation, personal and family privacy and personal image, property
rights and all rights of any other nature belonging to a third party; c) the execution
of acts of disloyal competition and unauthorised publicity; d) the absence of veracity,
exactitude, thoroughness, relevance and/or topicality of the Materials transmitted,
diffused, stored, received, obtained, made available or accessible on the Portal;
e) the inadequacy for any type of proposal and the defrauding of expectations generated
by the Services provided by third parties; f) non-fulfilment, delay in fulfilment,
defective fulfilment or termination for any reason of the obligations contracted
by third parties and contracts made with third parties in relation to or with regard
to the provision of Services; g) mistakes and defects of any kind in the Services
provided by third parties, as well as for the mistakes and defects of any kind in
the Materials transmitted or made available, received, obtained or those accessed
via the Portal or the services.
6.- The Portal provides technical link devices at the Users' disposal (links, banners,
buttons, etc.), directories and search tools that allow Users to access web sites
belonging to and/or managed by third parties (hereinafter, Linked Sites). The installation
of these links, directories and search tools in the Portal does not presuppose any
type of connection or association between the Holder and the operators of the Linked
Sites.
7.- The Holder does not undertake any type of responsibility for damages and detriments
of any kind that could be due to: a) the functioning and availability of the Linked
Sites; b) the maintenance of the Services, information, data, products and any kind
of existing material in the Linked Sites; c) the provision or transmission of the
services, information, data, products and any kind of existing material in the Linked
Sites; d) the quality, legality, reliability and usefulness of the services, information,
data, products or any kind of existing material in the Linked Sites.
8.- The Holder does not control nor offer any kind of guarantee with regard to the
Users' identity, nor with regard to the veracity, validity, thoroughness and/or
authenticity of the data that they provide about themselves and/or make accessible
to other Users, excluding any responsibility for damages and detriments of any kind
that may be due to the Users' incorrect identity and the absence of veracity with
regard to the information they provide about themselves.
5. Use of the Portal, the Services and the Materials falls under the exclusive responsibility of the User
The User expressly recognises and voluntarily accepts that use of the Portal and
the Services and any of the Materials falls within his exclusive and sole responsibility.
6. Refusal of access
The Holder reserves the right to refuse or withdraw access to the Portal and/or
the Services without prior notification from Users who fail to comply with the applicable
General or Particular Conditions.
7. Cookie technology
When the User surfs the Portal websites and pages, the Holder uses cookies (data
files that are generated in the User's computer). These cookies are only associated
with an anonymous User and his/her computer. These cookies allow the Holder to recognise
the registered Users once they have registered for the first time. The User has
the possibility of configuring his browser in order to be advised of the reception
of cookies and to prevent the installation of cookies on his hard disk.
The said cookies: a) cannot provide references that will permit personal data about
the User to be deduced; b) cannot read data from the hard disk; c) cannot read the
cookie files created by other suppliers.
It is not necessary to install cookies in order to use the Portal. Inwhich case,
the User will have to register every time he accesses a service that requires prior
registration.
8. Data of a personal nature
In order to access and/or use any of the Services and/or Materials, it may be necessary
for the Users to supply the Holder with data of a personal nature (hereafter referred
to as, Personal Data) that the Holder will process automatically and incorporate
into an automated file, which will, where appropriate, be registered with the competent
authority on the understanding that under certain circumstances this Personal Data
may be transferred to third parties. The Users may exercise their rights of access,
cancellation, rectification and opposition by contacting the Holder at the email

9. Applicable law and jurisdiction
These General Conditions are governed by Mexican law. The User and the Holder hereby
expressly renounce their respective jurisdiction and any other rights that they
may have, expressly submitting themselves, in the event of any litigation, controversy
or complaint, as well as with regard to the interpretation of these conditions,
to the jurisdiction and competency of the Courts and Tribunals of the city of La
Paz.
